苏州工业园区优化营商环境行动方案

?

为深入贯彻落实党中央、国务院和省市决策部署,积极构建法治化、国际化、便利化营商环境,弘扬亲商安商优良传统,创新厚才爱才工作举措,以制度创新为牵引,全面加快产业创新和科技创新,打造开发区改革创新高地,全面推动高质量发展,加快建设世界一流高科技产业园区,制定本方案。

一、工作目标

全面贯彻党的十九大精神,以习近平新时代中国特色社会主义思想为指引,主动对标国际先进理念、领先标准和最佳实践,借鉴新加坡营商环境建设经验,以优化企业服务和人才服务为重点,加大营商环境改革力度,以优质的制度供给、服务供给、要素供给和公平的市场体系,减少企业办事流程环节,降低制度性交易成本,增强市场主体竞争能力,激发人才创新创业活力,着力构筑最佳营商环境,将苏州工业园区打造成为国内外投资者信赖、海内外人才向往的发展热土,走在全国开发区营商环境建设最前列。

二、主要任务

(一)精减企业办事环节

按照能减则减、能免则免、能合则合、能快则快的原则,优化一网通办服务模式,减少审批环节,压缩办事时限,创新服务方式,让数据多跑路,让企业少跑腿,打造企业办事环节最少、政府服务效率最高的营商示范区。

1. 简化企业开办手续。简化企业从设立到具备一般性经营条件所必经事项的环节,提供线上全链通、线下一窗式相融合的服务方式,鼓励引导市场主体将开办企业涉及的工商登记、公安刻章备案、银行开户等涉企事项集成办理,实现开办企业全流程1个工作日内完成。推行负面清单以外领域外商投资企业商务备案与工商登记一口办理,办理时限压减至1个工作日。实现园区所有涉及市场准入事项证照分离改革全覆盖,进一步精简涉企证照,加强事中事后监管和信用体系建设。积极向上级部门争取重点行业审批赋权,服务企业对上争取获批相关行业许可证,破解准入不准营难题。(责任部门:行政审批局、组织部、市场监管局、经发委)

2. 优化工程建设项目审批流程。加快立项用地规划许可、工程建设许可、施工许可、竣工验收并联审批,推进消防设计、人防设计、施工图审查等多审合一以及规划、土地、消防、人防、抗震设防要求、档案等事项限时联合验收,将一般工业建设项目从立项用地规划许可到施工许可的审批承诺时间压减至20个工作日,其他项目同步减少。试行工业项目土地带方案出让制度。制定工程建设项目审批事项清单、告知承诺制的审批事项清单和事中事后监管措施。简化中小型社会投资工程建设项目审批和临时用电、用水手续。实体经济企业不动产登记办理时限压减至2个工作日。(责任部门:规建委、国土环保局、行政审批局、园区消防大队、档案中心)

3. 提高环境影响评价审批效率。巩固国家生态工业示范园区建设成果,创新环境影响评价管理机制,研究制定建设项目环保审批正面清单,探索实行承诺审批”“容缺后补等措施,精简环境影响评价报告内容,统一发布环境质量信息,将环境影响报告书和报告表审批时限压减至5个工作日。优化环评信息公开模式,环境影响评价报告表受理和拟审批公示期不少于5个工作日。加强环评中介机构服务和指导,定期开展考核通报,提高环境影响评价报告质量,进一步发挥环评机构企业服务作用。(责任部门:国土环保局)

4. 改进水电气接入服务。用水、用气装表接入无需增设管线的办结时间压减至4个工作日,需增设管线并办理行政审批事项的办结时间用水压减至23个工作日、用气压减至33个工作日。1020)千伏高压用户、400伏低压非居民用户电力报装时间分别压减至50个工作日和7个工作日以内。开展国家分布式光伏发电市场化交易试点,推动能源供给侧结构性改革,探索新能源生产和消费的自由交易。完善水电气停供提前告知机制,允许企业在减排量达标前提下,采取集中停产或错峰生产等个性化限停产措施。(责任部门:经发委、规建委、国土环保局)

5. 简化企业注销程序。建立企业注销网上服务专区,推行工商、社保、税务等部门注销业务信息共享、同步指引,实现企业注销一网服务。大幅简化注销登记程序和材料,取消向登记机关备案清算组程序,通过国家企业信用信息公示系统获取清算组信息、发布注销公告,办理注销登记时仅需提供《清算报告》等必要件。对未办理过涉税事宜或办理过涉税事宜但未领用发票、无欠税(滞纳金)及罚款的纳税人免予办理清税手续,直接向登记部门申请简易注销。(责任部门:行政审批局、劳动社保局、园区税务局)

6. 优化企业破产退出机制。推行破产案件繁简分流、快审快结。做好困境企业分类处置,对于暂时经营困难但是适应市场需要、具有发展潜力的企业,鼓励和引导适用重整、和解程序,帮助和支持符合产业政策要求的企业恢复生机、重返市场;对于资不抵债、丧失自我修复和发展能力的僵尸企业,及时启动清算程序,依法有序退出市场,力争破产财产变现最大化、成本最小化。(责任部门:园区法院、经发委、国资办)

(二)降低企业运营成本

坚持行政引导与市场主导相结合的原则,持续为企业减负松绑,千方百计压降企业显性和隐性运营成本,打造综合运营成本最低、市场竞争能力最强的营商示范区。

7. 营造最简最优的税收环境。深化财税体制改革,推进税收治理现代化,全面落实国家及省市减税降费优惠政策,对符合条件的纳税人实行即报即享、应享尽享。推行纳税人全程网上办最多跑一次清单,高频税收业务实行套餐式办理,不见面办税业务量达到95%以上,涉税事项窗口即时办结率达到90%。增强政策确定性,提供申报缴税、预约办税、智能信息推送等个性化、管家式纳税服务。压缩退税办理时间,出口退税申报、审核、审批、退库全流程实现无纸化,出口退税一、二类纳税人申报退税办理时间不超过 1个工作日,三类纳税人不超过 3个工作日。推广使用网上办税、手机办税、移动缴税。简化纳税人跨区域涉税事项报验程序,实施省内跨区域涉税事项报告表全程电子化办理。(责任部门:园区税务局)

8. 清理规范涉企收费。全面贯彻落实国家和省市清费降本减负各项要求,清理规范涉企行政事业性收费,实行园区本级零收费,进一步减轻企业负担。继续简化收费流程,创新缴费方式,节约企业缴费时间。严禁区内金融机构以贷款承诺费、资金管理费等名义向小微企业收取各类违规费用,严格限制向小微企业收取财务顾问费、咨询费等费用。开展涉企经营服务性收费专项清理行动,规范环境治理、安评环评、检验检疫检测、货运物流等领域和环节涉企收费项目。建立健全行业协会乱收费投诉举报、查处、整改等闭环管理机制。深化生产许可证制度改革,引导督促认证机构降低收费标准。(责任部门:财政局、经发委、金融管理局、国土环保局、综合执法局、市场监管局、社会事业局)

9. 提高用地用房效率。设置公平合理竞买条件,维护土地市场持续健康稳定。探索产业用地项目先租后让、租让结合、分期供地、弹性年期出让的供地方式,试点先短期出让,考核后再长期出让的供地模式,提高土地资源调控能力,降低企业发展成本。推行供地出让双合同监管模式,探索购买第三方服务方式开展土地利用动态巡查,引导企业按照合同约定开发利用土地。积极落实低效工业用地再开发政策,支持企业参与盘活存量土地,推进城市更新。研究制定园区地下(地上)空间建设用地使用权利用有关政策,完善地上、地表、地下空间分层利用制度,鼓励地下(地上)空间开发,最大限度提高土地节约集约利用水平。支持多家总部企业组成联合体联合竞投、联合建设总部大楼。鼓励工业上楼,提高产业用地容积率。增加国资高标准产业用房和配套设施供给。加强对厂房租金的监督检查,严厉打击囤积厂房、哄抬租金等违规行为。(责任部门:国土环保局、规建委、经发委、国资办、投促局)

10. 推动资源要素向优质企业集聚。结合企业资源集约利用综合评价结果,实施资源要素差别化政策,加大对高效益、高产出、高技术、高成长性企业的扶持力度。对综合评价A 类(优先发展类)、B 类(鼓励提升类)企业,重点支持申报各级涉及企业扶持资金项目、认定类项目和企业项目核准备案,优先保障电、天然气等用能需求,重点保障扩改建时新增污染物排放总量指标平衡以及实施区域污染物限排时正常生产,并给予信用评级、贷款准入、贷款授信和利率优惠等支持。(责任部门:经发委、科信局、规建委、国土环保局、金融管理局)

11. 提升贸易便利化水平。构建无缝对接上海口岸的水陆空大交通、大物流、大通关体系,在园区药品口岸增设首次进口药品和生物制品进口备案,建设园区空运直通港,推进园区虚拟空港与上海机场联动对接,为企业进一步缩减物流时间和物流成本,支持园区港至上海港支线驳船享受优先靠泊绿色通道服务和装卸费率优惠。深化贸易多元化试点和企业增值税一般纳税人资格试点,持续推动内外贸一体化发展。优化综合保税区封闭管理模式,推动海关、综保区等多部门联动审批,打造通关+物流货物跟踪查询应用系统。支持中欧卡航等第四方物流模式,降低企业物流成本。支持企业做好AEO申请认证,降低企业通关环节行政服务费用,在园区口岸开展区内企业免除吊装、移位、仓储等费用试点。创新担保方式,支持综保区企业采取关税保证保险、增信融资担保、企业集团财务公司担保等多元化担保方式。海关监管货物从综合保税区与区外之间进出的,高级认证企业免于提供担保。试点供应链协同出口改革,大力发展国际理货服务。鼓励企业开展保税研发、保税检测、再制造等业务。积极推进进口非特殊用途化妆品备案管理改革试点。(责任部门:园区海关、高贸区、经发委、行政审批局、市场监管局)

12. 破解融资难、融资贵。发挥中国和新加坡金融创新合作优势,支持园区内企业到新加坡发行人民币债券,拓宽融资渠道。鼓励园区企业对照资本市场上市和挂牌标准开展股份制改造。持续扩大区域股权投资基金规模,优化苏科贷、科技贷、园科贷、扎根贷、知识贷、绿色智造贷等金融创新产品,提高轻资产科技创新型企业融资效率,大力支持符合条件的园区企业赴上交所科创板、香港联交所等直接融资。发挥大中型银行头雁效应,增加制造业中长期贷款和信用贷款,实现区内国有大型商业银行小微企业贷款增长30%以上。支持银行对中小微企业开展无还本续贷业务,推动企业转贷业务扩面增效。创新关助融企业增信惠企举措,将企业海关信用信息纳入商业银行等金融机构对企业融资分析的数据池,提升企业在金融机构的贷款或保函额度,对优质信用企业贷款利率给予适当优惠。推进跨国公司总部开展外汇资金集中运营管理,支持跨国企业集团办理跨境双向人民币资金池业务。(责任部门:金融管理局、经发委、科信局、园区海关)

13. 优化企业人力资源保障服务。高水平建设人力资源产业园,大力发展人力资源外包、高级人才寻访、人才测评、人力资源管理咨询等新业态。实施人力资源蓄水池计划,多渠道保障企业用工需求。加大稳岗支持力度,对上年不裁员或少裁员的园区企业,可按企业及其职工上年度实际缴纳失业保险费的50%予以返还。深入开展职业技能提升行动,着力解决人力资源结构性矛盾。每年组织不少于2000名企业班组长开展免费培训,降低一线员工的流失率。每月举办2降本增效免费主题招聘会,降低企业招聘成本。推进社保(公积金)业务服务应网尽网,全面实现线上办理。优化企业特殊工时审批服务,积极支持企业实行特殊工时制度,促进企业提高管理水平和劳动生产率。(责任部门:劳动社保局、组织部)

14. 搭建创新服务和产业平台。对标行业最高标准,提升生物医药产业园、纳米城、创意产业园、国际科技园、人工智能产业园、纳米大学科技园、智能网联示范区等重大科技和产业创新载体运营服务水平,完善生物药分离纯化、微纳机电制造、软件评测等公共技术服务平台功能。大力支持纳米真空互联实验站二期、国家细胞应用科学设施、超算中心等重大科技基础设施以及中科院空天信息研究院苏研院、上海药物所苏研院等重大创新平台建设,争创国家级生物药大分子产业创新中心等高水平创新平台。支持跨国公司、海外学术和科研机构在园区设立研发机构或技术转移机构,鼓励有条件的企业建立海外研发中心,走出去引进国际先进技术和其它创新资源,构建以园区为核心的全球创新枢纽。围绕特色新兴产业,举办一批具有较强行业影响力、社会关注度、产业带动力的博览会、学术会议,促进产业盛会的常态化、品牌化和国际化。创新科技管理体制机制,探索高新技术企业认定流程和方式改革,完善以赛代评”“以投代评等科技项目形成机制。(责任部门:科信局、经发委、投促局、国资办)

15. 加强知识产权创造和保护。打造知识产权创造核心区,加大授权发明专利奖补力度,提升高质量、高价值专利创造能力。围绕园区主导产业,对拥有核心技术、解决卡脖子难题的知识产权企业给予重奖支持。鼓励企业开展国际专利布局,支持企业参与国际标准和规则制定,开展PCT国际专利申请和商标国际注册,突破技术和贸易壁垒。实行最严格的知识产权保护制度,加快建设专利行政执法全流程监管系统,开展打击侵权专项行动,强化知识产权保护行政执法与刑事司法相衔接。对知识产权诉讼涉案企业终审胜诉或和解获利的区内企业事业单位,给予一定补贴。加大国家中小微企业知识产权培训(苏州)基地、中国(苏州)知识产权保护中心及园区重点产业知识产权运营中心建设力度,积极探索支撑创新发展的知识产权国际化运行机制,打造知识产权的国际合作样板区。(责任部门:科信局、市场监管局、园区检察院、园区法院、园区公安)

(三)优化企业对外投资服务

积极参与一带一路、长江经济带、长三角一体化等重大战略,对投资园区和合作共建园区的企业一视同仁给予优质服务,帮助企业打开发展空间,打造利益共享、共同发展的营商示范区。

16. 完善企业境外投资政策咨询和融资服务。依托国家级境外投资服务示范平台、长三角境外投资促进中心以及金鸡湖境外投资服务联盟,推进对外投资项目库、资金库、信息库的网络平台建设,为对外投资企业提供专业有效的培训,加强金融保险、专业咨询和法律事务所等机构对接合作,引导企业稳健走出去实施跨国经营。鼓励金融机构为企业走出去创新金融产品,探索创新融资抵押方式,运用优惠贷款+商业贷款”“直接融资+间接融资”“股权+债权等方式,帮助走出去企业拓宽融资渠道。支持走出去企业发行债券融资,通过境内外上市进行直接融资。支持保险机构开展出口信用保险和海外投资保险,为企业走出去提供投资、运营、用工等方面保险服务,提升企业信用等级。(责任部门:投促局、经发委、金融管理局)

17. 支持企业开展跨区域产能合作。深化区域互利合作,探索利益共享机制。支持区内企业根据转型提升需要,采取总部(园区)+基地(合作共建园区)”“研发(园区)+生产(合作共建园区)等方式,对外开展绿地投资、并购投资、联合投资等,拓展贸易渠道,推动产能有序梯度转移。协助企业开展对外投资风险评估,坚定维护企业合法权益,帮助企业防控和降低对外投资风险。(责任部门:经发委、投促局、科信局、国资办)

18. 支持企业对外开展创新合作。深化园区与发达国家和地区之间的科技合作,提升创新资源优化配置能力。支持区内企业到园区在全球创新资源密集的地区设立的海外创新中心,开展离岸创新活动,在租金减免、薪酬补贴等方面给予优先支持,帮助企业建立海外优质创新资源的发现、筛选和引育机制。深化与海外名城名校合作,鼓励国际知名高校、科研机构、内外资企业在园区合作建设科研创新平台。(责任部门:科信局、国资办)

(四)优化公共服务供给

更好地发挥政府在资源配置中的作用,以企业需求为导向,以企业评价为标准,推进公共服务领域供给侧改革,打造公共服务品质最佳、现代化治理水平最高的营商示范区。

19. 加强智慧城市建设。推动产业网络化、数据化、智能化,抢抓5G商用发展机遇,加快人工智能、工业互联网、物联网等新型基础设施建设,尽早实现园区主要区域和公共场所5G的深度覆盖。全力打造精品高速网络,在光纤网络、移动网络和窄带物联网(NB-IoT)全覆盖的基础上,加快部署基于IPv6的下一代互联网,高水平建设园区国科数据中心(Tier4级)、电信和联通IDC等云资源池以及超级计算中心,加快推进5G技术在车联网、智慧城市、工业互联网和智能制造等领域的垂直应用。(责任部门:经发委、科信局、园区电信、园区移动、园区联通、铁塔公司)

20. 加快社会信用体系建设。健全公共信用信息服务平台,推进信用信息的归集、共享和使用,率先探索打破信用信息壁垒。完善以信用承诺为基础、信用产品为工具、信用管理为手段的新型企业服务模式,利用大数据对企业进行信用画像,将信用信息查询和联合奖惩措施应用嵌入行政审批、事中事后监管、公共资源交易、招投标等业务流程机制,减少监督检查频次等正向激励措施。参与和探索推进长三角地区信用标准互认,实现跨区域信用信息交换共享和联动奖惩,积极参与信用长三角品牌建设。(责任部门:经发委、市场监管局、行政审批局、规建委)

21. 保障各类企业公平参与政府采购。推行互联网+”政府采购模式,实现线上、线下双通道采购、提高企业参与的便利性。依法审查参与企业的资格条件,切实保护参与企业的商业秘密,对有各类不良信用记录的企业依法实施联合惩戒,强化政府采购领域企业违法违规情形的监督处罚力度。严禁以不合理的条件对相关企业参与政府采购实行差别待遇或者歧视待遇。(责任部门:财政局、办公室、市场监管局)

22. 加大法治政府建设力度。坚持将法治作为最好的营商环境,推进重大行政决策规范管理标准化体系化试点,推行重大决策项目网上运行,完善公众参与、专家论证、风险评估、合法性审查和集体讨论相结合的行政决策实施程序。进一步优化全国首批合作制试点机构功能,为园区企业和居民提供业务全面、质量最高、最为便捷的公证服务。优化律所库+法律顾问模式,创新正向激励、违规惩戒、容错纠错等举措,完善律所库成员单位分级管理机制,发挥法律顾问政府参谋助手作用。(责任部门:办公室、政法委)

23. 加强各项产权保护措施。建立涉企产权案件立案登记绿色通道,提高产权、合同执行等案件的审判执行效率。依法界定涉案财产,不得因企业股东、经营管理者个人违法,任意牵连企业法人合法财产。妥善处理公司决议效力、股东知情权、利润分配权、优先购买权和股东代表诉讼等纠纷案件,加强对中小股东合法权利的司法保护,推动公司治理结构完善。研究建立因政府规划调整、政策变化造成企业合法权益受损的依法依规补偿救济机制。(责任部门:园区法院、园区检察院、经发委)

24. 大力弘扬企业家精神。依法保护企业家财产权、企业家创新权益和企业家自主经营权。健全企业家参与涉企政策制定和评估机制。实施优秀企业家创新提升工程,开展精准化的理论培训、政策培训、科技培训、管理培训、法规培训,增强企业家发现机会、整合资源、创造价值、回馈社会的能力。加大对优秀企业家的表彰激励和公益宣传力度,发挥示范带动作用。(责任部门:经发委、科信局、组织部、宣传部、园区法院)

25. 规范监管执法行为。对标国际通行规则,依法规范企业监管。实行最严格的安全生产监管制度,严把立项、规划、设计、审批、建设的安全关口,对不符合产业政策和规划布局、达不到安全标准的,一律不予建设和投入运行。对发生重大生产安全事故的企业,依法实施停业整顿或关闭退出;对有安全生产违法违规行为、严重失信行为的投资主体及管理者,依法实施市场限入或禁入。加快推进市场监管领域双随机、一公开检查事项全覆盖。进一步规范和控制涉企各类检查活动,严格控制重点检查事项数量和一般检查事项抽查比例。对能够严格落实法律、法规、规章要求,认真执行安全、环保政策标准规定,积极配合政府日常监管的企业给予压减检查频次等正向激励。对不涉及安全生产和人民群众生命财产安全的市场主体轻微违法行为慎用查封、扣押等措施,探索建立行政处罚事前警示、首次豁免、信用修复等多层次容错纠错机制。(责任部门:综合执法局、市场监管局、国土环保局、规建委、劳动社保局、园区法院、园区消防大队、经发委)

26. 规范政商交往行为。坚持有求必应,无事不扰,完善领导干部挂钩联系服务企业机制,探索设立重点企业服务专员制度。建立跨部门走访、执法的联动协作机制,避免交叉执法、重复检查。严格遵守中央八项规定精神和其他规定,严格执行园区规范政商交往正面清单,妥善处理”“关系,主动靠前服务、热情搞好服务,擦亮园区亲商服务品牌。(责任部门:经发委、投促局、科信局、纪工委)

(五)优化人才服务举措

坚持将人才服务作为企业服务的核心内容,以更加开放的人才政策,创造最具竞争力的引才、育才、用才、留才环境,打造海内外人才向往、企业人才保障最强的营商示范区。

27. 深化实施人才安居工程。对入选金鸡湖人才计划的各类人才实施差别化奖励和扶持措施。金鸡湖人才最高可享500万元购房补贴。本科以上紧缺人才可享3年拎包入住的全装修优租房;继续加大人才组屋、人才优购房及人才优租房供给。针对在园区就业、创业并连续缴纳社保或个税12个月及以上,且在本市无自有住房的本科及以上人才,继续探索实施优先购买普通商品房政策。对在园区单位工作且在缴存住房公积金的人才,给予住房公积金缴存、提取、放宽贷款条件和提高贷款额度的优惠。(责任部门:组织部、规建委、国土环保局、科信局、劳动社保局)

28. 畅通高端人才服务绿色通道。为各类金鸡湖人才提供创新创业、出入境便利、社会保障等全方位咨询与帮办服务。符合条件的金鸡湖人才,其子女可享受区内地段生同等待遇、公办学校就近入学,非公办学校每年24万元学费补贴,免费就读区内中等职业学校等入学优惠,本人可享受免费体检和VIP门急诊、住院等医疗保健服务。深化中新人才合作试点,自行开展外国人来华工作许可全流程审批,将外国人签证、居留许可的办证时间由15个工作日缩短至7个工作日。通过接受团队预约、设立绿色通道等措施,将普通办证排队时间缩短50%。开设高层次外籍人才预约窗口,实现随到随办。强化人才金融支持,面向人才企业开展投贷联动试点,探索设立金鸡湖人才基金。(责任部门:组织部、科信局、教育局、社会事业局、劳动社保局、金融管理局、园区公安分局)

29. 探索接轨国际的人才奖励政策。探索建立人才津贴制度,给予园区认定的高端人才和紧缺人才最具竞争力的薪酬、住房、创业、综合贡献等一揽子补助。科技型中小企业转增股本可分期缴纳个人所得税。区内非营利性研发机构和高等学校从职务科技成果转化收入中给予科技人员的现金奖励,符合相关政策规定的,可减按50%计入科技人员当月工资、薪金所得缴纳个人所得税。(责任部门:组织部、科信局、财政局、园区税务局)

30. 营造人才创新创业浓厚氛围。探索海外科技人才回流机制,办好国际精英创业周活动,打造金鸡湖路演中心、金鸡湖创业大赛等自主品牌引才平台。支持建设留学人员联谊会、博士联谊会、人才促进会等高层次人才社团组织,通过专业化、常态化的活动,促进人才圈、社交圈、学术圈、投资圈交流互动。(责任部门:组织部、科信局)

三、保障措施

(一)加强统筹协调,强化责任落实。建立园区优化营商环境联席会议机制,形成齐抓共管的强大合力。各部门各单位要按照本方案精神,切实承担优化营商环境主体责任,深入分析本部门本单位营商环境中的突出问题,找准政策落实的薄弱环节,制定时间表和路线图,提出切实可行的操作办法。将优化营商环境纳入年度重点督查事项和绩效考核体系,建立营商环境投诉举报和查处回应制度,对落实不力的部门、单位追责问责。每年委托第三方机构对实施情况开展评估及模拟测评,并发布评估结果。

(二)着眼企业需求,确保精准施策。加大营商环境跟踪研究力度,及时调整不符合发展趋势、不适应现实需要、不具备兑现条件、不明确落地流程的涉企政策条款,增强政策的稳定性和连续性。全面采用成本收益分析,对优化营商环境具体政策进行事前评估,防止给企业增加不合理的制度成本、时间成本和经济成本。对企业敏感的行业规定或限制性措施调整要设置合理过渡期,防止脱离实际、层层加码。动态对标国际标准和国内先进地区,积极借鉴、复制营商环境建设先进经验。

(三)深化宣传推介,做好政策解读。对于市场主体关注的重点难点问题,及时研究解决,回应社会关切,合理引导预期。对于已出台的优化营商环境政策措施,及时跟进解读,准确传递权威信息和政策意图,并向企业精准推送各类优惠政策信息,提高政策可及性。精心举办各类宣讲咨询活动,提高园区营商环境显示度、美誉度和影响力,吸引高端创新要素集聚园区,营造凝心聚力建设世界一流高科技产业园区的浓厚氛围。

Action Plan for Optimizing Business Environment in SIP

?

The Action Plan is formulated to fully implement decisions and guidelines by the CPC Central Committee, the State Council, Jiangsu Province and Suzhou Municipality with a view to building a legally-based, international and favorable business environment where we will stick to pro-business and pro-talent principles. Driven by institutional innovation, SIP will speed up industrial and technological innovation to build itself a highland for reform and innovation as well as a world -class high-tech industrial park.

Part One: Objectives

We will put the guiding principles of the 19th National Congress of the Communist Party of China fully into action and be guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era.? We will benchmark against international advanced concepts, standards and learn from experiences, including business environment development by Singapore. We will deepen the reform of business environment with our focus on optimizing services to enterprises and talents, striving to increase competitiveness of enterprises and aspiration of talents by streamlining all kinds of procedures and reducing costs. We aim to build SIP into a leading development zone in China in terms of business environment and a paradise for investors and talents home and abroad.

Part Two: Main Tasks

I. To Streamline Procedures in Doing Business.

According to the principle of simplifying, exempting, combining and speeding-up of relevant administration procedures, we target to build a demonstration area with simplified procedures in doing business and efficient governmental services. We shall optimize the online platform for integrated government services (one.sipac.gov.cn), streamline approval procedures to the largest extent, compressing examination and approval time, seeking new ways of service and letting data travel for enterprises and people.

1. Simplify enterprise registration. We shall streamline the business establishment procedure from registration to completion with basic requirements for operation fulfilled, combining online services throughout the chain and offline services finished at one window. Market entities are encouraged to integrate business-related affairs such as business registration, public security seals filing and bank account opening, so that business establishment can be done within 1 working day. Business record and registration of foreign-invested enterprise in the areas beyond the negative list shall be done at one window with one form within one working day. The reform of separation of permits from business license shall cover all the matters involving market access. We shall further simplify business licenses and establish an end-to-end supervision and credit system. We will strive to be authorized to conduct approval of key industries and help enterprises to obtain business permits, and we will put an end to the phenomenon of “letting firms in but not letting them do business”.

2. Streamline approval of construction projects. Through one-time chained examination and approval of multiple items, and one-time all-around construction inspection, we will make sure that the whole approval for normal industrial construction projects will be finished within 20 working days, as well as for other projects synchronously. We will pilot transfer of land for industrial projects along with the project plan, and formulate lists and actions on approvals and inspections as well as notification commitment system. Procedures of project examination and approval, temporary electricity and water will also be simplified for small and medium-sized non-government invested construction projects. Real estate registration of enterprises in the real economy shall be done within 2 working days.

3. Enable more efficient environmental impact assessment approval. We shall consolidate the achievements as a national demonstrative eco-industrial park, innovating the management system of environment impact assessment and making positive list of construction project environment impact assessment. Environment quality information shall be released in a unified manner. Both of the environmental impact statement and the environmental impact report shall also be simplified and its approval shall be done within five working days. We shall optimize environment assessment data disclosure. The environmental impact report shall be published for public supervision for at least 5 working days before approval. We will promote services and guidance from agencies for environment assessment, making regular circulars on environment assessment and improving the quality of the reports.

4. Provide better water, electricity and natural gas service. Installation of water and natural gas without additional pipelines shall be done within 4 working days, and 23 and 33 working days respectively when additional pipelines are needed. Installation of electricity shall be done within 50 and 7 working days respectively for high voltage users of 10 (20) KV and low voltage non-resident users of 400 V. We will carry out pilot projects of market-oriented transaction of distributed photovoltaic power generation, promote supply-side structural reform of energy and explore free trade in new energy production and consumption. The notification mechanism for supply cut will be further improved and enterprises will be allowed to take individualized suspension measures on the premise of meeting emission reduction target.

5. Simplify cancellation of registration. We shall set up a specialized online service section for cancellation of business, social security and taxation registration where multiple departments share information and make simultaneous guidance, enabling cancellation to be finished on one website. The procedures and documents required will be largely simplified, and liquidation group information retrieval and cancellation publicity will be conducted on the National Enterprise Credit Information Publicity System and only necessary documents such as liquidation report need to be provided for cancellation registration. Tax payers meeting certain requirements will be exempt from tax clearance and can apply for easy cancellation directly.

6. Optimize the bankruptcy and market exit mechanism. We will separate simple and complex cases and accelerate the procedure. Enterprises in difficulties will be arranged under two categories. Adaptive and potentially promising ones will be given support and guidance to readjust to the market. Zombie companies which are no longer solvent should be brought into orderly bankruptcy proceedings in time according to law to maximize realizable assets and minimize losses.

II. To Lower Costs of Doing Business.

We target for lowest comprehensive business costs and highest competitiveness in the market. We shall stick to market-driven and administratively-guided principle and continue to lessen business pressure by reducing explicit and implicit costs.

7. Optimize taxation service.

We shall advance the reform of the fiscal and tax systems and modernize tax governance, and fully implement tax preferential policies at all levels and benefit entities virtually. We will enable more items to be handled online to realize “one-time visit” by taxpayers. Packaged services shall be provided regarding regular tax affairs and over 95% matters be handled without the need for tax payers to be physically present.? Additionally, over 90% tax related matters can be finish-up immediately at service window. We shall make policies more identifiable by promoting individualized online services of tax filing, reservation, etc. The whole process of export tax rebate application, examination and approval will be paperless and shall be done within 1 day and 3 days for Class-1 and -2 taxpayers and Class-3 taxpayers respectively. We will promote applications of online or mobile phone tax services. We shall also streamline cross-regional tax applications, including entirely digitalizing related reports.

8. Regulate charges and fees levied on businesses. We shall fully implement national and provincial requirements to curtail fees and charges and alleviate the burden on businesses. SIP will not impose administrative fees on local enterprises. We will continue to rationalize the procedure, innovating payment methods and reduce the time required. Any illegal fees on SMEs by local financial organizations are strictly forbidden and consultant fees are restricted. We will overhaul service charges on businesses including environment governance and assessment, security assessment, inspection and quarantine, logistics, etc. An industry-wide closed circular management system of complaint and report, investigation, prosecution and rectification regarding arbitrary charges shall be established. We will deepen the reform of production permit and urge certification institutions to lower the costs.

9. Improve land and housing efficiency.

We shall facilitate fair and proper auctions to stabilize the healthy land market. We will explore new ways of supplying industrial land, including land use right transfer after leasing, combination of leasing and transfer, examination and supply by stages and flexible period of transfer. We will pilot “short-term transfer” followed by long-term one to strengthen mobilization and control of land resources and reduce costs for business development. We will conduct supervision via land use and construction contracts and explore dynamic examination of land use via third-party services to guide enterprises to develop and utilize land according to the contracts. We shall actively carry out redevelopment of inefficient industrial lands and encourage enterprises to contribute to putting idle lands to better use. We shall formulate policies on rights to underground (over ground) land for construction, improving layered utilization of land and the efficiency and intensity of land use. Enterprise headquarters are encouraged to coalesce in bidding and constructing headquarters, and industries are encouraged to operate on higher floors to increase land use efficiency. We will provide more state-owned high-standard industrial housing and ancillary facilities and act more actively on factory rent inspection and punishment of illegal conducts in this regard.

10. Pool resources to high quality businesses. Based on the assessment of intensive use of resources, more resources will be pooled towards high-efficiency, high-yield, high-technology and high-growth businesses. Favorable policies for those identified as of development priority (Class-A) and support (Class-B) include preferential terms for financial support projects, specialized projects, project approval and record procedure, electricity and natural gas supply, guarantee for production during reconstruction, credit grading, loan access , loan credit and loan rate, etc.

11. Further facilitate trading. We shall connect seamlessly with Shanghai land, water and air ports. Medicine and biological products imported for the first time shall be filed at the SIP port for medicine. The SIP virtual airport will be connected with Shanghai airports to further compress logistic time and cost for enterprise. We will introduce preferential terms for barges from the SIP port to feeder ports of Shanghai Port. We shall pilot more diversified trading and qualification of general taxpayers for enterprise value-added tax, and integrate domestic and foreign trades. We shall promote closed management of the integrated FTZ, joint examination and approval by multiple departments, and a goods-tracking system. We will support enterprises to develop new channels of international logistics (eg. SINO-EUROPE TRUCKING SERVICE) and apply for AEO certification, and cut down on charges at the ports. We shall innovate guarantee methods, supporting the integrated FTZ in pluralistic guarantee and enterprises with an AEO certification will be exempt from guarantee for cargo under customs supervision going in or out of the integrated FTZ. We will pilot the reform of coordinated export in supply chains and record of non-special use cosmetics, and develop international tally and stow services and encourage enterprises to set up relevant services.

12. Address challenges in accessing affordable financing. We will support SIP enterprises to issue RMB bonds in Singapore, and to reform the ownership according to relevant standards. We shall facilitate investment of equity funds, innovative financial products, financing by asset-light innovation and technology enterprises, and direct financing by SIP enterprises in STAR market and SEHK. Large and medium-sized banks are taken as pioneering examples to boost medium and long term loans and credit loans in the manufacturing industry and stimulate loans granted to SMEs by large state-owned commercial banks by 30% and above. We shall support SMEs in loan services including renewal and onlending. We will innovate the business credit management system, share enterprise customs credit among banks and increase the maximum amount of loan or guarantee. Enterprises with a good credit shall enjoy proper preferential terms in loan interest rate. We shall also encourage the multinationals to conduct centralized management of foreign exchange capitals and engage in cross-border two-way RMB capital pool services.

13. Improve human resources and social security services. We will step up efforts in the development of a high-level HR Service Park where new models emerge such as human resource out-sourcing, talent hunting and assessment, and HR consulting. We will build a talent pool to facilitate human resource recruitment. We will further stabilize employment. SIP enterprises with zero or few layoffs during the previous year will be given 50% refund of the unemployment insurance paid by the enterprise and its employees during that year. We will further implement the vocational skills training initiative and strive to solve structural issues of human resources. We will organize no less than 2000 enterprise team leaders to conduct free training annually to reduce the turnover rate of production-line employees and hold free job fairs twice every month to reduce the recruitment cost of enterprises. We shall fully digitalize social security (provident fund) services and support special work hour arrangements to promote business management and productivity.

14. Build service innovation platforms. We will benchmark against the highest industry standards in developing operation service level of major innovation and technology carriers and platforms including Biobay, Nanopolis, International science and technology park, artificial intelligence industrial park and intelligent network demonstration area, in addition, improve the function of public technical service platform including biological drug separation and purification, micro-nano electromechanical manufacturing and software evaluation. We will support major technology infrastructures including Vacuum Interconnected Nanotech Workstation, national cell application facilities, and Supercomputing Center, and innovation platforms including Suzhou branches of Aerospace Information Research Institute and Shanghai Institute of Materia Medica, two institutes set by Chinese Academy of Sciences. We will strive to build national-level quality innovation platforms such as macromolecular bio-medicine innovation center. Multinational and foreign corporations and academic and R&D institutes are encouraged to come to SIP while local enterprises are encouraged to build overseas R&D centers, introducing international advanced technology and other innovative resources to build a global innovation hub with SIP as a core. We shall focus on emerging industries and promote international brand industry fairs on a regular basis, including expos and academic conferences with strong industry influence, public attention and industrial driving force. We will explore the reform of the identification process and method of high-tech enterprises and improve the formation mechanism of science and technology projects such as “competition instead of evaluation”, “investment instead of evaluation”.

15. Strengthen intellectual property rights creation and protection. Target to build an intellectual property creation core area. Enterprises will get more reward for high quality and value patent creation therefore enhance the capability to create high-quality and high-value intellectual property. We will focus on IPR intensive industries which possess core technologies and can solve problems that are seriously constraining development. Enterprises will be encouraged to participate in international standard and rule-making and apply for PTC patents and international registration of trademark. We will implement the strictest IPR protection system ,speed up the construction of a full-process supervision system for patent administrative law enforcement and strengthen the linkage between administrative enforcement of intellectual property rights protection and criminal justice. We also shall carry out special actions to combat infringement. We shall set subsidies for successful litigant enterprises in IPR lawsuits. We will promote the construction of relevant training and protection centers, seeking an internationalized scheme and shaping SIP into a model zone for international cooperation in IPR.

III. To Render Better Outbound Investment Services.

We target for interests sharing and common development. We shall uphold major strategies including the Belt and Road and integrated development of the Yangtze River Economic Belt and Yangtze River Delta. Enterprises investing in or jointly building industrial parks will be treated equally in quality services.

16. Improve outbound investment policy consulting and financing. We will rely on national demonstration platforms and institutes, overseas investment promotion center of Yangtze River Delta as well as overseas investment service alliance of Jinji Lake to build online platforms of outbound investment projects, capitals and information, provide professional training, facilitate cooperation among relevant organizations, such as financial insurance, professional consulting and law firms, and guide businesses to go outbound. We will encourage financial organizations to provide special financial products to outbound businesses and explore innovative financing mortgage methods, such as “preferential loans + commercial loans”, “direct financing + indirect financing”, “equity + creditor’s rights” and other ways to help “go out” enterprises broaden financing channels and support those enterprises to raise fund through bond issuance and go public in the domestic and foreign markets. We will support insurance organizations to provide export credit insurance and overseas investment insurance which may cover investment, operation, employment and so forth, and improve the credit rating of enterprises.

17. Advance industrial capacity cooperation cross regions. We shall further promote mutually beneficial cooperation between regions and build a system to seek common interests. We will support enterprises in SIP who are in the needs of transformation and upgrading, to seek new ways of development through the coordination of headquarters (park) and bases (co-construction of parks), R&D (park) and production (co-construction of parks), etc. and via outbound green field investment, merger, joint investment, etc., to expand trade channels and promote orderly gradient transfer of capacity. We will also assist in investment risk assessment and legal rights protection for enterprises doing outbound businesses.

18. Encourage international innovation cooperation. We will further cooperate with developed countries and regions in sci-tech areas and optimize innovation resource allocation. SIP enterprises are encouraged to establish innovation centers in innovation resource intensive regions worldwide, and can enjoy priority support in terms of rent reduction, subsidies, etc. in such areas. We will assist these enterprises to establish a mechanism for overseas innovation resource discovery, screening and development. We shall also boost cooperation among international education and R&D institutes and domestic and foreign enterprises to build innovation platforms.

IV. To Optimize Public Services.

We target for optimal public services and modernized governance. We shall enable the government to better play its role in resources allocation and deepen the supply-side reform in public serves, led by enterprise demands and assessments.

19. Build smart cities. We shall further digitalize industries, strengthen novel infrastructures including AI, industrial internet, IoT, etc., and seize the opportunity of commercializing 5G, aiming at extensive 5G coverage in main areas and public venues. We will build a high-standard high-speed network with full coverage of fiber optic network, mobile communication network and NB-IoT, develop next internet protocol based on IPv6, and construct the Tier4 Suzhou International Science-Park Data Center, Cloud resource pools of Telecom and Unicom IDC and supercomputing centers. We will promote 5G applications in Internet of Vehicles, smart cities, industrial internet, smart manufacturing, etc.

20. Establish a social credit system. We shall optimize the public credit information service platform to facilitate credit information collection, sharing and utilization, and take the lead in exploring and breaking the barrier of credit information. We will improve the new service model for enterprises based on their credit commitment and via credit products and management. We will embed credit information inquiry and joint reward and punishment measures in business process mechanisms, such as approval, the interim and Ex Post supervision, public resources trading, bidding etc., so as to reduce the frequency of supervision and inspection and other positive incentives. We shall also facilitate cross-regional mutual recognition, data sharing and joint rewards and punishments in the Yangtze River Delta, and actively participate in the “credit Yangtze River Delta” brand building.

21. Ensure that all businesses can take part in government procurement activities on an equal footing. We shall promote the Internet Plus government procurement and conduct online and offline procurement in the meantime, in order to render easier enterprise participation. We will examine enterprise qualification according to law and protect their business secrets, and strengthen punishment of bad credit records and illegal behaviors in the field of government procurement. Differential treatment or discrimination shall be strictly forbidden in government procurement.

22. Strengthen the building of a government based on the rule of law. The rule of law shall be the best business environment. We will explore standardized and systematic management of major administrative decisions, online decision-making and decision implementation involving public participation, risk assessment, legal examination and discussion. We shall further enhance the functions of the first batch of pilot notarization institutions established through cooperation to provide all-around, high-quality and efficacious notarization services to enterprises and residents in SIP. We should optimize the model of “law firms + legal advisers”, explore innovative measures such as positive incentives, disciplinary measures against violations, fault tolerance and error correction etc., and improve the hierarchical management mechanism of members of law firms. In addition, we shall improve the legal consulting system and let legal counsel play the role to assist the government.

23. Strengthen property right protection. We shall render more efficient case registration and trials regarding business property rights, and improve the efficiency of trial and execution of property rights, contract execution and other cases. Properties involved shall be identified according to law and no legal properties of the legal person shall be involved in personal cases by shareholders and managers. Disputes concerning the validity of company resolutions, shareholders’ right to know, the right to profit distribution, the right of preemption and shareholders’ representative litigation etc., shall be properly dealt with and rights of small, and middle shareholders shall be under greater judicial protection, so as to promote the? corporate governance structure perfection. We will form a compensation and relief mechanism in terms of infringement on enterprises due to adjustment of government plans and policies.

24. Uphold entrepreneurship. We shall protect entrepreneurs’ rights in terms of property, innovation and operation, better involve entrepreneurs in relevant policy making and assessment. We will launch innovative upgrading projects for outstanding entrepreneurs, including theoretical training, policy training, scientific and technological training, management training and law and regulation training etc., to enhance entrepreneurs’ ability to discover opportunities, integrate resources, create value and give back to society. We will also do more to commend outstanding entrepreneurs and promote their stories to the public to set examples for them to follow.

25. Regulate oversights and law enforcement. We shall align our policies with internationally accepted rules in business oversight. We will implement the toughest possible oversight on work safety including project setup, planning, design, approval and construction and those failing to meet safety requirements or not conformity with industrial policies and planning layout, shall not be allowed to bring into effect. Where major workplace accidents, illegal behaviors against work safety, or other serious dishonesty occur, enterprises shall be suspended from business or closed, or investors and managers be limited or forbidden into the market. Oversight conducted through the random selection of both inspectors and inspection targets will be fully implemented and the result will be made to public in a timely manner. We will further regulate and control examinations on businesses, including strict controls on the number of key inspection items and the proportion of spot checks of general inspection items. Enterprises who can strictly implement the requirements of laws, regulations and rules, conscientiously implement the safety and environmental protection policies and standards, and actively cooperate with the daily supervision of the government, should be given positive incentives such as reducing the frequency of inspection. For those minor illegal acts committed by market participants that do not involve safety in production and the safety of people’s lives and property, measures such as seizure should be prudently taken. We will also explore to establish mechanisms of “allow for and address errors”, such as warning beforehand administrative penalties, first exemption, credit restoration.

26. Regulate officials’ exchanges with businesspeople. Officials shall be responsive but not initiative to trespass on businesspeople. We shall improve the mechanism of designating officials in business services and professionals to serve major businesses. We shall establish an interconnected and coordinated mechanism of interdepartmental visits and law enforcement to avoid duplicate law enforcement and examination. We will strictly abide by the spirit of the Eight Provisions of the CPC Central Committee and other regulations, and strictly implement the positive list of standardized political and commercial exchanges in SIP, to form a new type of cordial and clean relationship between government and business, and promote pro-business services in SIP.

V. To Optimize Services for Talents.

We target for favor from domestic and foreign talents and optimal personnel guarantee. We shall take services for talents as the core of services for businesses and open up relevant policies to appeal, cultivate, utilize and keep talents.

27. Further carry out talent housing projects. We will provide differential housing reward and subsidy policies, for instance, “Jinji Lake Talents” can enjoy a maximum of 5 million RMB of housing subsidy. Talents in urgent need (holding a bachelor degree or higher) will have access to low-rent fully-furnished apartments for 3 years. We will provide more housing for sale and rent respectively. Talents working or startup in SIP but hasn’t own housing in Suzhou and meeting certain requirements, such as who is undergraduates and above and has been paying social security or individual tax for 12 months consecutively, will be given priority in the pre-sale permitted ordinary commercial housing. Talents working in SIP and depositing housing provident fund shall be given preferential treatment for depositing, withdrawing and relaxing the loan conditions and increasing the loan quota of housing provident fund.

28. Smooth the “green channel” for high-end talents. Jinji Lake talents will be provided with all-around consulting and agent services in terms of innovation and entrepreneurship, facilitation for border entry and exit, social security and so forth. Some of those talents will be given privileges in medical and healthcare services, such as free physical examination and VIP outpatient, emergency, hospitalization and other medical and health care services. Their children can enjoy the same treatment as students in the district, the close enrollment of public schools, the tuition subsidy of 20,000-40,000 yuan per year for non-public schools, and the free admission preferential treatment for secondary vocational schools in the district. We will deepen pilot talent cooperation with Singapore, enable independent approval of foreigner work permits, and the processing time for foreigners to get a work visa and residence permit will be compressed to 7 working days. We will shorten the time required waiting in line for ordinary permit application by 50% and allow high-level foreign talents to make reservations so that they do not have to wait in the hall. We will provide more financial supports for talents, including loans and funds.

29. Explore tax policies for talents to international standards. We shall provide competitive subsidies for high-end talents and those in urgent need working in SIP, including the most competitive compensation, housing, entrepreneurship, comprehensive contribution and other “package” subsidies. Personal income tax related to equity converted from capital reserves in Sci-tech SMEs can be paid in installments. Researchers of non-profitable institutions and colleges within SIP who contributes to commercialization of innovation outcomes, will be given cash rewards. Scientific and technological researchers meeting certain requirements can enjoy preferential policies for income tax, that is, personal income tax can be paid by 50% of the monthly salary.

30. Boost innovation and entrepreneurship. We shall form a mechanism to attract talents in sci-tech areas back to China from overseas, holding activities such as “International Elite Entrepreneurship Week”, and building Jinji Lake Road show Center, Jinji Lake Entrepreneurship Competition and other independent brand platform. We will support the construction of high-level talent associations, such as overseas students’ associations, doctoral associations and talent promotion associations. We also shall regularly organize specialized activities to boost exchanges among talents, scholars and businesspeople.

Part Three: Safeguard Measures

1. Strengthen coordination and responsibility fulfillment. We shall establish a joint meeting mechanism for optimizing business environment in SIP. Relevant administrative authorities shall stick to this Action Plan and take solid measures to shoulder the primary responsibility. They should act to explore key issues and weakness in implementing policies, formulate time schedules and road maps, and work out practical approaches. Optimization of business environment shall be included into annual key inspections and evaluations and performance appraisal, and shall be put under a complaint, reporting and punishment system. We will entrust to a third party every year to assess the implementation, examine it through simulation, and release the results.

2. Be oriented to enterprise demands and perform targeted policies. We shall strengthen business environment tracking and research to respond instantly to improper policies which are not in line with the development, do not meet the needs of reality, cannot be fulfilled and do not have confirmed implementation process, and ensure stable and constant policy implementation. Relevant policies shall be evaluated beforehand with cost and profit overall assessment to avoid unnecessary institutional, time and financial costs. Business codes and measures unfavorable to or restricting enterprises should allow transition for them and unpractical conducts shall be avoided. We will be dynamic to keep pace with international standards and domestic pioneers, learning from their experiences.
